These Terms & Conditions (“Terms”) govern your access to and use of the website, online ordering portal, and in-store services provided by TS Photo, LLC (DBA: The Print Refinery Louisville East) (“we,” “our,” “us”). By using our services, you agree to these Terms. If you do not agree, please do not use the site or place orders.

1) Accounts & Eligibility

  • You must be at least 18 years old (or have legal guardian consent) to place orders or create an account.
  • You are responsible for maintaining the confidentiality of your account and password and for all activity under your account.
  • Information you provide must be accurate, current, and complete.

2) Orders, Proofs & Approvals

  • Order review: Please review cart details, sizes, quantities, finishes, and options before checkout.
  • Proofs: Where provided, digital or physical proofs represent approximate output. Color/density may vary by device, lighting, and material.
  • Approval: Your approval (including payment without requesting changes) authorizes production. After approval, changes may require a new order and additional charges.
  • User-supplied files: You are responsible for content, spelling, grammar, DPI, and trim/bleed safety unless otherwise contracted for design services.

3) Color Management & Materials

  • Reasonable variation in color, density, and substrate appearance may occur due to device calibration, ink/paper lots, acrylic/metal/plastic batches, and environmental conditions.
  • Unless you purchase a contract color proof with written tolerance, we produce to professional lab standards with commercially reasonable effort.
  • Reprints for color concerns are handled per Section 10 (Returns/Remakes). A reprint may not exactly match a prior run due to process variability.

4) Turnaround, Deadlines & Rush

  • Estimated turnaround starts after file receipt, successful upload, payment, and (if applicable) proof approval.
  • Rush services may be available for an additional fee and depend on capacity and materials.
  • We are not liable for delays due to file issues, approvals, vendor backorders, carriers, weather, or other events beyond our control.

5) Shipping, Pickup & Delivery

  • Risk of loss: Transfers to you upon carrier pickup or customer pickup. Inspect shipments upon receipt.
  • Damage in transit: Keep packaging and notify us within 48 hours so we can assist with a carrier claim. Photos may be required.
  • Local pickup is available during posted business hours. Please bring order confirmation and ID if requested.

6) Pricing, Taxes & Payments

  • Prices are shown in USD and may change without notice prior to order placement.
  • Applicable taxes and shipping/handling fees are added at checkout.
  • We accept the payment methods presented at checkout. Orders may be paused or canceled for suspected fraud or non-payment.

7) Content You Provide

  • You represent and warrant that you own or have obtained all necessary rights, permissions, and licenses for any content you upload or request us to print.
  • You agree not to submit content that is unlawful, infringing, defamatory, hateful, harassing, obscene, or otherwise prohibited.
  • You grant us a limited, non-exclusive license to reproduce your content solely for the purpose of fulfilling your order and related customer service.

8) Prohibited Uses

  • No unlawful activity, malware, scraping, reverse engineering, or interference with site operation.
  • No upload or printing of content that violates copyrights, trademarks, privacy rights, or publicity rights.
  • We may refuse any order in our reasonable discretion.

9) Promotions, Gift Cards & Credits

  • Promotions or promo codes are subject to stated terms and expiration. Not redeemable for cash unless required by law.
  • Gift cards and store credits are redeemable for eligible purchases and subject to applicable state law.

10) Returns, Remakes & Order Issues

  • Custom products: Most items are made-to-order and not refundable once produced. If there is a production defect or damage in transit, we will reasonably repair, reprint, or replace at our discretion.
  • Report window: Please report quality or order issues within 7 days of pickup/delivery with photos and your order number.
  • Approved remakes are limited to the original order specifications unless otherwise agreed and may require return of the original item(s).

11) SMS & Email Terms

Brand: TS Photo, LLC (DBA: The Print Refinery Louisville East)

Types of SMS messages we send: Transactional order-related messages only, such as order confirmations, production updates, pickup or shipping notifications, and follow-ups about a specific transaction. We do not send marketing via SMS.

  • Message frequency disclosure: Message frequency varies based on order status; no more than 4 messages per order.
  • Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
  • HELP: Text HELP for help, or email louisvilleeast@theprintrefinery.com.
  • STOP/Opt-out: Text STOP to stop receiving SMS messages.
  • Consent: By providing your mobile number during checkout or customer service, you consent to receive transactional SMS about your order. Consent is not a condition of purchase.

Email: We use email for transactional communications (confirmations, proofs, updates, billing, customer service). Marketing emails, if any, are sent only if you opt in; you can unsubscribe from non-transactional emails at any time via the link provided.

12) Intellectual Property

  • All site content, layouts, product descriptions, and brand assets are owned by us or our licensors and protected by IP laws.
  • Except as expressly permitted, you may not copy, distribute, modify, or create derivative works from our content.

13) Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

14) Warranties & Disclaimers

  • Services are provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
  • Reasonable color/finish variance and minor material characteristics do not constitute defects.

15) Limitation of Liability

  • To the fullest extent permitted by law, our total liability for any claim arising out of or relating to an order or your use of the services is limited to the amount you paid for the specific order giving rise to the claim.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or use.

16) Indemnification

You agree to indemnify and hold harmless TS Photo, LLC (DBA: The Print Refinery Louisville East) and its personnel from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your content, your misuse of the services, or your violation of these Terms or applicable law.

17) Governing Law & Disputes

  • These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
  • You agree to the exclusive jurisdiction of state and federal courts located in Jefferson County, Kentucky, for disputes not eligible for small-claims court.
  • Nothing here prevents either party from seeking equitable relief for misappropriation or infringement of IP rights.

18) Force Majeure

We are not responsible for any delay or failure to perform due to events beyond our reasonable control, including but not limited to supply chain issues, vendor outages, labor shortages, natural disasters, or carrier interruptions.

19) Changes to Terms

We may update these Terms from time to time. The latest version will be posted on this page with the effective date. Continued use of the services constitutes acceptance of the updated Terms.

20) Severability & Waiver

If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of our right to do so later.
